Behind on Your Mortgage or Facing Foreclosure
Foreclosure is not inevitable. If you act before the auction date, a short sale can stop the process, protect your credit, and give you a dignified exit on your own terms.

Can a short sale help if I am facing foreclosure?
A short sale may be an option. The bank must say yes before the home goes to auction. Acting early gives you more time. Bay Area homeowners who are behind on their mortgage can get a free review of their options.
How Much Time Do You Have Before Foreclosure?
California foreclosure moves on a legal timeline. Once the process starts, each step narrows your options. The earlier you act, the more control you keep.
Missed payments
Foreclosure risk begins after 3–4 missed payments. The lender may send a breach letter.
Notice of Default (NOD)
Filed with the county recorder. You now have at least 90 days before the next step.
Notice of Trustee Sale
Filed after the NOD period. Auction is scheduled at least 21 days out.
Trustee Sale (Auction)
The home is sold at auction. You lose all control at this point.
A short sale can be initiated at any point before the trustee sale. Even after a Notice of Default is filed, you still have time. Do not wait.
Short Sale vs. Foreclosure: Understanding Your Options
- Less credit damage — a short sale typically drops your score 50–150 points vs. 100–200+ for foreclosure
- Shorter wait to buy again — 3–4 years vs. 7 years with foreclosure
- You control the sale — you pick the agent, list the home, and work with buyers
- California anti-deficiency protections apply in most short sales
- Employers and landlords view short sales more favorably than foreclosures
- You avoid the public stigma and legal proceedings of a foreclosure auction
